Standard terms and conditions of contract

These terms and conditions apply to all bookings for the purchase of training from Hampshire Academy Training.

A minimum number of delegates is required to run a course and we reserve the right to cancel or reschedule any of our courses if the minimum number is not met. Where it is necessary to cancel or reschedule a course, you will be informed at the first available opportunity and delegates will be rescheduled as a priority to the next available course(s). We understand there may be a need to refund payment if a suitable course date cannot be supplied within a given time. We do not accept any responsibility for certificates expiring as a result of a cancelled course.

Course prices

Individual delegate prices are quoted on the booking form and will be reviewed annually. Hat reserve the right to offer a discount to companies booking more than two places on any one course. Group booking prices are quoted on an individual basis, based on location, course type and venue hire.
We are not VAT registered.

Payment

Invoices will be sent one month prior to the course start date. If full payment is not received by the date stated on the invoice HAT reserve the right to cancel the booking or withhold certificates until full payment is made and cleared.

Company Cancellations

If you are booking as a company, a 75% charge will be made for cancellations made a week or less before the course start date. Courses cancelled 2-4 weeks before a course start date will incur a 50% charge. This applies to both scheduled courses and group bookings. Consumer Cancellations

All bookings group or individual, have 14 calendar days in which to cancel from the date it was made. If your course is due to start within this 14 calendar day period charges will be made as stated above.

Scheduled courses
Transfers

You can transfer a delegate without incurring a charge, providing we receive the request at least 7 working days before the course start date and a space is available. If you book a course less than 10 working days before the course start date, you will not be able to make a transfer, except in the event of illness. Substitutions

Like for like substitutions will be accepted provided that the request is received before the course start date either by phone 02381 786722 or email jeanette@hampshireacademytraining.co.uk

Group bookings
Transfers

No charge will be applied to a date transfer request, provided it is received at least 14 working days before the course start date. Any transfer requests received fewer than 14 working days before the course start date will incur a 50% charge of the course fee.

Course start times and joining instructions

We strive to ensure good time keeping throughout the course, but in unforeseen circumstances timings may change slightly. We will issue full instructions/information regarding course details and location via email to the appropriate person on the booking form. It is the responsibility of the appropriate person on the booking form to pass course information to delegates attending the course, which includes information regarding the start time. Information regarding course details will be sent one month prior to the course start date. If the person booking the course/places has not received course information 14 days before a course start date it is their responsibility to contact HAT on 02381 786722 or email jeanette@hampshireacademytraining.co.uk

Failure to attend the course due to not receiving course information will result in the full cost of the course being charged. It is the responsibility of the booker to ensure that delegates are fully briefed and made aware of all course requirements before attending the course.

Attendance

Delegates must attend and complete and pass all aspects of the course to qualify for certification. The full cost of the course will be charged for delegate(s) who arrive late or are absent from all or part of the course. Every reasonable effort will be made to assist the delegate in completing the full course booked, but in some cases may be offered a part qualification e.g. (Full PFA offered Emergency First Aid one day providing all aspects of the one day have been completed).If the trainer decides a delegate has arrived too late to do the course Jeanette Walker will be contacted at the earliest possible moment who will assess the circumstances and decide an appropriate course of action.

Meeting the needs of delegates

Hampshire Academy Training have an Equal Opportunities Policy. We ask you to declare on the booking form any delegates with a special requirement in order for us to ensure that all customers are treated fairly and their needs fully met. You can contact Jeanette Walker on 02381 786722 or email jeanette@hampshireacademytraining.co.uk prior to any course to notify us of any special requirement a delegate(s) need in order to enable them to participate fully in the training. Reasonable adjustment may be applied under the guidance of the awarding body or HAT policy and procedures. We do not provide any specialist equipment and/or personnel such as signers or translators, but they can be sourced and paid for by the client.

Selecting suitable personnel

The employer is responsible for selecting suitable staff for training especially first aiders. It is important chosen staff are:

  • Mentally and physically fit and able to carry out the role they are training for and can provide first aid cover in the work place. e.g. able to kneel and administer cardiopulmonary resuscitation (CPR) on the floor. The duties of a first aider can be demanding and time consuming therefore selecting suitable people is vital in ensuring adequate cover is provided by the employer. The Health and Safety Executive’s (HSE) Approved Code of Practice states, delegates must be free from any condition that will affect their participation in the course and their capability to carry out the duties of a first aider.
  • Reliable, with the necessary disposition and communication skills to carry out the role they are training for in the workplace.
  • Able to cope with stress and the physical demands of emergency procedures and other incidence
  • Can be easily reached in the event of an emergency/incident at work.
  • 16 years old and above.

Delegates who are unable to meet the above requirements or fail to meet the pre-set assessment criteria for first aid courses will not be awarded a certificate and will therefore be unable to act as first aiders within the workplace.

Re-certification

It is the employer’s responsibility to ensure that all delegates attending a first aid at work requalification course hold proof of a current (in date) first aid at work certificate and provide a copy of the certificate at the time of booking. The certificate should be valid for the duration of the requalification course being attended.

Limitation of liability

Except in respect of death or personal injury caused by our negligence, we shall not be liable by reason of any representation (unless fraudulent) or implied warranty condition or other term, or any duty at common law or under the express terms of this agreement, for any loss of profit or any indirect special or consequential loss, costs, expenses or other claims for compensation. Our entire liability to you under or in connection with this agreement and the provision of the first aid training shall not exceed the sum of twice the contract value. Nothing in this paragraph is intended to exclude any liability on our part for fraud.

Data Protection Act 1998

It will be necessary to share personal data collected with appropriate awarding bodies/organisations to apply for certificates. Non-sensitive data will be used for the purpose of delegate(s) and course administration to evaluate and make improvements and meet quality assurance procedures.
Information gathered may also be used for marketing purposes and you may be contacted by telephone or e-mail with details of future similar events and courses organised by HAT or promoted by us which may be of interest to you. We will not share personal data with any organisation other than that stated above. Contact details supplied to us will not be passed on to third parties.

We will not send marketing communication to any individual or organisations who have requested that their details are not used for such purposes.
Appropriate measures are taken to keep your information secure, accurate and up to date, and data is only kept as is reasonable and necessary. If personal data is disclosed, HAT will ensure the bodies/organisations to which the personal data is shared maintain equivalent measures and processes. A copy of our confidentiality/data protection policy can be requested.

Personal information we hold about you

You can request details of the personal information we hold about you under the Data Protection Act 1998. We may require you to pay an administrative fee of £10.00 before we act on your request.

Governing Law

These terms and conditions and all matters connected with any order you place on our website shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the jurisdiction of the courts of England.
